City Clerk’s Duty

The City Clerk is the official custodian of the city’s public records and is responsible for the legal retention of city records and preservation of archival documents. The City Clerk receives and responds to public record requests.

Records Information

City records include all writings made, maintained, or kept by the city, regardless of physical form or characteristic. Most city records are public records. Colorado statutes define what specific records are not public and you will be informed if the information you request is not available to you for that reason.

Time Kept

Even though most city records are public records, they are not all kept forever. The City Clerk’s Office is responsible for the city’s Records Management Program and the Colorado State Archives reviews and approves the city’s retention schedule. Once a record reaches the end of its assigned retention period, it is scheduled for destruction.


Open Records Request

Making Your Request

To make an open records request, please complete the open records request form and submit it to the City of Lone Tree’s City Clerk’s Office. Upon receipt of a public records request, the city will make the requested documentation available within three working days or less. Should extenuating circumstances exist a seven-day extension to the three-day rule.

The more specific you can make your request; the better your chances of finding the information you want. Vague or broad requests can be costly to the requestor, as there are research fees involved for records searches.

Research & Retrieval Policy

All requests which require copies, and/or retrieval costs, and/or research fees, require payment in advance prior to retrieval of the records.

Response time pursuant to the Colorado Open Records Law:
24-72-203 – The date and hour set for the inspection of records not readily available at the time of the request shall be within a reasonable time after the request.

As used in this subsection (3), a “reasonable time” shall be presumed to be three working days or less. Such period may be extended if extenuating circumstances exist. However, such period of extension shall not exceed seven days.

A finding that extenuating circumstances exist shall be made in writing by the custodian and shall be provided to the person making the request within the three-day period.

Access to and Denial of Records pursuant to the Colorado Open Records Law:
24-72-305.5 – Records of official actions and criminal justice records and the names, addresses, telephone numbers and other information in such records shall not be used by any person for the purpose of soliciting business for pecuniary gain.

The official custodian shall deny any person access to records of official actions and criminal justice records unless such person signs a statement which affirms such records shall not be used for the direct solicitation of business for pecuniary gain.
