Tobacco Licensing

On March 16th, 2021, the Lone Tree City Council passed Ordinance 21-04 requiring tobacco retailers to obtain a retail tobacco license in order to sell tobacco products within the city. The Colorado Legislature passed legislation in June, 2021, requiring tobacco retailers to also acquire a state retail tobacco license to sell tobacco products within the state. To sell tobacco products in the city of Lone Tree, a retailer must have both a city and state retail tobacco license.

City Licensing Application:

For a city retail tobacco license, complete the application and pay the initial fee of $250. The license will need to be renewed annually each December with a renewal application and fee of $200. Applicants may submit their applications by mailing applications and payments to City Hall, or by emailing completed applications to [email protected]. Starting in 2022, a basic tobacco training course will be required for all employees submitting for new licenses and renewals.

Retail Tobacco Requirements:

Listed below are some specific requirements for retail tobacco licensing. Please review Ordinance 21-04 for all the licensing requirements.

  • Anyone who sells a tobacco product is required to obtain and maintain a license from the City of Lone Tree for each location where tobacco product retailing occurs.
    • The initial retail fee is $250 and annual renewal is $200.
  • The minimum sale age for tobacco products has been raised from 18 to 21.
  • Retailers must examine identifications to confirm that the recipient is at least 21 years of age.
  • Retailers must display the tobacco retailer license in a publicly visible location.
    • Retailers must display signage indicating that tobacco products shall not be sold to any person under 21 years of age.
  • The sale of tobacco products from vending machines and self-service displays is prohibited. All tobacco products shall be inaccessible to customers without the assistance of a retail clerk.
  • No person under the age of 18 is allowed to sell tobacco products.
  • Tobacco product sales are prohibited within 500 feet of schools that serve grade 7 and above. Retailers operating lawfully on June 1st, 2021 are exempt from the 500-foot prohibition.

State Licensing Application:

The Colorado Department of Revenue Liquor and Tobacco Enforcement Division has its own application process for retail tobacco licenses. To apply for the state license, visit the Colorado Department of Revenue webpage here.
